Supreme Court throws out Wichita man's 'Hard 50' sentence

WICHITA, Kan. — The Kansas Supreme Court today reversed a "Hard 50" sentence handed down in a Wichita murder case. he justices ordered Rogelio Soto be remanded for a new sentence.

Rogelio Soto is in prison for the March, 2009 stabbing death of Arturo Moreno. Moreno was stabbed 79 times, and his body was later found at a home in the 800 block of South Market. Soto was 16 years old at the time.

The justices ruled the "Hard 50" sentencing scheme was unconstitutional because it allowed a judge to determine whether one or more aggravating factors existed rather than requiring a jury to determine if aggravating factors existed.
