Judge Upholds Damages In Military's Misdiagnosis Of Flesh-Eating Bacteria

A federal judge has let stand most of the $8.5 million he awarded a woman who lost the use of an arm due to a flesh-eating bacteria misdiagnosed by a military doctor.

Magistrate Judge Phillip Frazier turned aside much of the government's request to cut the damages for Jean Phillips by more than $1 million. He trimmed them by less than $63,000.

Phillips is the ex-wife of a Scott Air Force Base captain. The judge found that a doctor at the southern Illinois base assumed she was an addict looking for prescription drugs when she sought treatment in 2002.

Her rash turned out to be flesh-eating bacteria.
