MAIZE, Kan. (KAKE) - Joshua Cohen and Kassidy Tucker spent weeks at Mo's A-Maize-N BBQ, helping to open the restaurant.

Cohen and Tucker claim that after a few workplace disputes, owner Eric King fired them, and the assistant manager.

They say, however, that they haven't been paid for the time they worked there, so Cohen contacted the U.S. Department of Labor.

"Now that the U.S. Department of Labor kind of went after him, he made an agreement with them for $900 plus for myself claiming I only made minimum wage there," Cohen said. "He also claimed Kassidy never worked there, not even a day ... never worked there, which is untrue."

Screenshots show Tucker was in fact on the payroll.

She said that she found it odd that King suggested that she get paid through Cash App and not a typical direct deposit, but Tucker said that she still wants the money she's earned.

"I just put in my Cash App because it was easier. And he said it would get us paid quicker. So that's what I did. I did exactly what he said. And I still haven't seen anything from him," Tucker said. "I check my cash app daily, just in hopes that maybe they'll give it to me."

Cohen is now taking legal action against the restaurant for his full back pay.

"I'm currently in the process of trying to put together a civil lawsuit just to get the rest of the money," Cohen said. "But my hope is that he forgoes this, pays the penalties like he's supposed to, and we both go our separate ways. And we tried, but it didn't work. There's nothing we can do."

We attempted to contact the restaurant and it's manager. When KAKE News got through to someone at the restaurant, they immediately hung up.
