WICHITA, Kan. (KAKE) - An affidavit released Wednesday by the Sedgwick County Court states Tyshon Jacques fatally shot an 18-year-old driver earlier this month while Jacques was in the backseat of the car. 

Police responded to the intersection of 3rd and Broadway near the downtown YMCA on the afternoon of October 2 where 18-year-old Ja'Qaulen Dupree was found unresponsive in the driver's seat with a gunshot wound to the back of the head.  Dupree suffered "massive brain damage" and was pronounced deceased at a local hospital, according to the affidavit.

Court documents say a number of witnesses observed a group of people exit the vehicle and run from it prior to it crashing into a pole and coming to a stop. 

Video surveillance from local businesses depicts the gray Dodge Charger come to a stop on Broadway north of 3rd Street, the affidavit says. Five people were observed exiting the vehicle. Four ran southbound through the parking lot and alley west of Market Street while the lone person ran southbound on Market Street. 

A young woman in the vehicle at the time of the shooting told police she heard a shot and saw Jacques holding a gun. The woman said there had been no arguments or reasons Jacques would have fired the gun. 

Jacques was charged with intentional second-degree murder on October 5 and remains jailed on a $500,000 bond.
