The newspaper filed a lawsuit today in order to obtain records regarding the police helicopter that crashed at Washburn University on April 4th.

The flight log typically contains the names of those on board as well as information about the flight and the helicopter.

They filed their lawsuit Tuesday in Shawnee County District Court. This comes after the Capital Journal says it requested the crash log for the chopper and were denied by Topeka Police Chief Ron Miller.

"Kansas Open Records are very clear and we feel very strongly that access to public information isn't up to the whims of public officials," said Managing Editor Wayne Stewart.

In a statement today city spokesperson Dave Bevens says that suing the city is premature because they are still working on the open records request.

"The City of Topeka received from the local daily newspaper an open records request. We acknowledged its receipt within three working days as required by law. We will respond to the paper no later than April 28. We are following the same process we always do when an open records request is filed." said City Spokesperson David Bevens.

Stewart says it would be great if the city follows through. However based on current occurrences, he has his doubts.

"They told us they were going to take another 2 weeks to find this information. We've been waiting 11 days for the Highway Patrol to file a police report for the crash. It's just not the way things should work. The public has a right to know," said Stewart. "It's not up to public officials to decide what you get and what you don't. There's a law. It's Kansas Open Records Law and it's very clear. We're not going to go away just because they say they're not going to provide the information. We're going to keep knocking on the door until we get what we want."

The question then, rs, is this - did the CJ ask for the report and were they told NO, or were they told to come back when the police have time to get the report out? All we read in the news is that they were told NO. Big difference. It seems to me that there has been plenty of time for the information to become available. The public's right to know should be a very high priority because that goes to the very heart of what our constitution stands for. Men and women have died to uphold that right.

the deal is the names will never come out no matter how long it takes. they seem to think time will linger,and we will forget about things! fat chance! how can we forget about a copter crashing at w.u. look how many people could had died because of policce stupidity. a cover up,all's you have to do is give the names up that crashed the copter. is that TO MUCH TO ASK FROM TOPEKA'S TAXPAYERS????? NOW HERE COMES :I:WONDERING ABOUT NOW THE HIGHWAY PATROL??? IS THIS CITY OFFICALS ALL CORRUPT? THEY ALL ARE WORKING TOGETHER,TO COVER UP AGAIN,(AT THE TAXPAYERS EXPENSE!) all too often lately, things are reported by "officials" as they cant give any details because of an investigation. if the details are ever released, it is way after anyone remembers what origionaly happened.

CJ has been waiting for 11 days for the Highway Patrol to file a police report. Is CJ going to sue the KHP over this or is it that they have a vendetta aginst the City of Topeka? CJ seems to twist everything that the City does so that they can inflame public opinion. The open reacords process has not changed in years. It is a matter of CJ thinking that their requests should be pushed ahead of all other requests. Their arrogant attitude is whiy I don't subscribe to CJ.

Mike: Requiring a governing body or its divisions to keep the people informed and NOT giving the appearance of trying to hide something...that is not ridiculous. It is demanding compliance with the law...even if a lollipop was suspiciously removed from it's owner by a governmental agency...the law says...OPEN THE RECORD and release the pertinent information.. IT"S THE LAW!

The only people giving out the victims names is the Public and people the "victims" know. It's all about their 15 minutes of fame and the chance to express their hate aginst our law enforcment dept. Of coures most of the people that deal with the law don't like them, so yea, they are going to do the best they can dog them out publicly. I say it's great they keep all information under wraps until they sort everything out. I would rather have the truth all at once instead of the story changing every day.

It's just like the officers that shot the llamas brothers,no names of police released. And,the lady policeofficer that tased a man to DEATH,no names released either. It's just another name cover up! They don't mind giving the names of the victims!!! the d.a. should allow officers named released just as well. To me,the d.a. is protecting the sherriff department and the t.p.d. on both of theses occassions! no more faith in the system, we all are on own!! Even though we pay theiir wages. WHAT IS IT GOING TO HURT TO HAVE THE NAMES RELEASED OF THE OFFICERS THAT WENT OWN IN THE COPTER?????????? just cover up everything,just like politics,so many cover ups from the system. HOW CAN WE FULLY TRUST THE D.A,T,P,D, ND THE SHERRIFF DEPARTMENTS.?????????? what is this coming too?????

The law says the citizens have a right to this information. I couldn't care less about what happened to the copter and I know there are good cops and bad cops. That's neither here nor there. When the law gives citizens a right to information and the police refuse to give out that information THEN I have a problem. If we can't trust the police to protect and uphold our right to know how our business is being conducted (as taxpayers with a legal right to know) then I guess that leaves us with the newspaper. Good luck to them.

I feel that the information should be available to all who want to read it. I also feel that the Capital Journal has the right to get all of that information.

what, just because they were needing another chopper, do they think they crashed it because of that, put lives in danger, and risk death? someone needs to be thankful for the work that is done in the police department. Topeka, i am sorry but i do not believe you will win any awards for the safest town or anything like that because you have too many idiots living there

WHAT!?!?! There are plenty more stories to publish in the paper. Why the need to draw this one out? Another lawsuit over something ridiculous.
