Officers were called at around 11 p.m. that night to Cloudridge Apartments in the 200 block of West 3rd. Berry's body was found in a bedroom. Police say she had a deep wound to her throat.

Smith, who was Berry's live-in boyfriend at the time, was found at a nearby apartment. He was questioned and released later that morning.

The release says that over the last 22 months, Det. Natasha Ward followed up on leads, reviewed evidence and interviewed potential witnesses.

Smith is currently incarcerated at the El Dorado Correctional Facility for a parole violation. Police say Smith will be served a warrant and is scheduled to appear in Butler County court on June 29.

Kansas Department of Corrections records show Smith has prior convictions of aggravated robbery, terroristic threat, forgery and driving while a habitual violator. He was scheduled to be released on July 1.
