WICHITA, Kan. (KAKE) -

A newly released court document is shedding more light on the horrible death of a 3-year-old Wichita boy and the apparent cover up.

The remains of Evan C. Brewer were discovered Sept. 2 inside a home in the 2000 block of South Vine. The child had been the subject of a custody battle for months.

His mother, Miranda Miller, and her boyfriend, Stephen Bodine, are charged with first-degree murder in Evan's death.

The documents state their landlord, after filing for eviction, was cleaning at the home when he found a suspicious structure.

Court transcript shows attempt to save Evan Brewer

Man at center of investigation into Evan Brewer's death says he didn't do it

"While working in the utility room in the back of the residence he attempted to move carpet from a covered platform that had tool boxes stacked on top of it. The platform was a large block of concrete, with a wooden lower frame, and caster wheels. This block is large enough to encase a child's body."

The landlord then went to buy a sledgehammer, returned to the property and began to break the block open because "he feared Evan was inside." After a rotten odor began emanating from the block, the landlord called 911.

Bodine initially told investigators that he did not know where Miller was keeping Evan, "but he is sure he is in safe hands."

When asked if Evan was inside the concrete block, Bodine twice told investigators "you wouldn't think so."

Family say Evan Brewer’s death was unstoppable despite attempts to save him

Remains later determined to be Evan's were found in the block, wrapped in roofing paper, Ninja Turtle beds sheets, duct tape, duct tape, linoleum flooring and bath towels.

In the home, police also found a hardware store receipt documenting the purchase of concrete, threaded rod and a trowel.

The document also details alleged abuse of Miranda in the home and says that Evan was afraid of Bodine. Police found videos that show the child tied up with a chain and naked.
