Three families are suing Saint Anne School and the Catholic Diocese of Wichita claiming discrimination.

The principal, Sister Margaret Nugent, took the witness stand Thursday, explaining the reasons for the school's "English only" policy. Her testimony lasted four hours.

Sister Margaret testified that the policy was implemented to prevent bullying, and to allow the kids to blend. Sister Margaret said she never felt the students were separated by language.

Saint Anne implemented the rule last fall after teachers started getting complaints from students, who said they thought the Spanish-speaking kids were calling them names in Spanish.

Three families, including Mike and Clara Silva, are suing the school, Sister Margaret Nugent and the Catholic Diocese for discrimination.

The families say their kids were singled out and made to sit apart from one another because of their heritage.

Sister Margaret says that isn't true. During her testimony, she said the kids were all told to mingle, with kids of all races, to create unity.

"It wasn't just the Hispanics, it was the whole sixth grade," Sister Margaret said.

Sister Margaret also told the court that because the teachers couldn't understand what the kids were saying when they spoke Spanish, it became divisive.

She testified that the school teaches in English, so she expects the kids to speak English at all times.

She also said that when she put the policy in place, she had no idea it would become such an explosive issue.

The plaintiffs rested their case today. The defense will open with its witnesses Friday.

Some of you are either not getting all the details or you are discriminating andjust defending these kid's because you are a friend or a Hispanic. This has nothing to do with being Hispanic. This rule applied to all children that spoke any foreign language. It happened that the children that were unruley were Hispanic and bullying other's and hollering profanity in their own language,at children so that they or staff did not understand their word's. Everyone had the priviledge of speaking in their own language, be it Vietnamese, Indochinese, Spanish, etc. Everyone had that priviledge, untill these kid's ruined the priviledge for everyone. There was nothing discriminating about this. If anyone was discriminating it was the H. children towards other children. It was a Hispanic child that interpreted what was being said and the bullying goes without saying. This is unexceptable regardless of ethnicity. Discipline and respect was needed in this situation. Parent's failed miserably!

I am a hispanic member of St Annes. I attended school their as do my children. Why are the Silvas the only names being released on the news? Because the other two families are not even citizens of our great country. St Annes has sent two different priests off for more than a month to learn Spanish so a mass could be said in their foreign language.Does that sound like discrimination? I grew up with Mike Silva and I know for a fact that his parents spoke ENGLISH to him and his siblings.The Silvas have had two children attend and graduate from St Anne with Sr Margaret as principal.Come on people we are dealing with a parenting issue.Why do the taxpayers have to pay for their lack of discipline. This is a waste of money and time especially Sr Margaret's. We get to start school without our principal. Thanks to the Silvas and whoever you other two are. I hope your sons don't spend my kids tax dollars on their law suits against future employers.Take a look at what you are teaching your kids.

I don't see where the school is depriving the kids of their heritige. They are trying to solve a problem with the kids speaking Spanish and the teachers and other children believing that they are being made fun of or ridiculed. The children are free to speak Spanish at home or out of school. The parents are the ones depriving their children of a basic lesson. One it is a private school and is going to have more strict rules than others. Two the idea that rules are for somebody else and not for you. If you don't like the rules you get a lawyer and claim discrimination. I wonder if the teachers will consider a lawsuit against the parents for their creating a hostile work enviornment? That is another federal law. I would be more than willing to help contribute to it. The parents of the other kids could also do the same thing since the parents are creating a learning environment that is hostile.

St. Anne's has done no wrong. Our family is Catholic and Spanish. The kids were making fun of others in spanish. The rules are made to prevent this. Oh how hard it is for some to follow rules! Shame on the families who are supposedly Catholic. This reminds me of Judas who turned Jesus in for the sake of a few coins.

These kids and there families just need to go back to Mexico or where they came from no one is forcing them to go to school there are they. WELCOME TO AMERICA...NOW SPEAK ENGLISH!!!

This America, and little by little its slipping away, before anyone knows we wont even have a country. It will just be a large extension of Mexico. There's nothing wrong with expecting the people in OUR country to speak OUR native language. This is just one small fight against a much larger one. And without people to stand up and say enough is enough were are just basically forfieting our large fight and giving our couuntry away. I am not racist in anyway and i believe they are here for thier families and to better thier lives, but it shouldn't be expected of our country to give up who they are

I have no problems with those kids speaking in their native language. I've learned that if you also pay attention to body language you can tell when someone is talking about you. In fact I busted 3 kids talking about me in spanish. I didn't quite understand what they were saying, but after I told them the total purchase of their order in spanish, they learned not to do it again. They learned that you may never know if people understand you or not.

You're right Annonymous, it is a "free" country,and it's OUR rights, that are being stepped on here! English is the language. When in Rome do as the Romans... when in the US Speak ENGLISH,and leave the spanish for at home or away from the school. It's OUR rights that are being taken away day after day and it's time we the "legal" citizens of the U.S. stand up and fight to keep those rights. For your information, a law suite is a suite of offices in a building for lawyers. We need more teachers and administrations like Sister Margaret!!

Why is this even news ? Because the times we have "made" dictate it is. When are the powers that be going to wake up and put a stop to this nonsense ? I`m afraid it may be too late to save our nation...

I listen to all sides of the argument or at least try to before I make comments. The people arguing for the students have no argument. 1. Kansas ellected English as its official language 2. The school is a private school. 3. No one is keeping the kids from their heritage, learn it at home, with friends off school grounds. My heritage is Irish and I am catholic, if my daughter was at school calling people names in Gaelic then I would expect it to be delt with, this will open the door for many more law suits that tie up the courts time. Clara you area an a$% and I know you personally, I will choose to not associate with you in the future. 4. Suits like this are what cause so many people to get upset when others try to stand up for their rights, because others always remember frivolous law suits such as this. You want to speak spanish everywhere you go, then go back to Mexico. If I want to speak Gaelic everywhere I go, I will go back to South Armagh where I am from.

An unfortunate situation. I fully support the diocese, school and Sr. Margaret. From what I read discrimination does not exist. It is a privilege to attend this school or any school in this diocese. This seems to be a waste of taxpayer dollars. I hope the parents prayerfully considered their actions and the potential effects on everyone.

First of all this is a private school who recieves NO federal funding thus they make their own rules. If these families feel that strong about speaking spanish then they can pull there kids out of that school,where they are not required to go, and send them to public school where they can speak Spanish or what ever language they choose. Another option is to return to Mexico where the national language IS Spanish. This is yet another black eye given to miniorities by miniorties.

I think the law suite is "GREAT" those kids were treated terrible and seperated from their friends."Shame on Sister Margaret"! I know one of the St.Anne's former students the parent and child had decided to leave the shcool after attending the school for 6 years due to the rediculas rules and the punishment that is inflicted on the students. Sister Margret needs to be re-evaluated regarding her responsibilty to the children there. Those parents pay WAY to much money for a education to St.Anne's I hope the parents/students win!!!!! Its a free country regardless of race or religion.

This is a waste on tax payers money. If you want your children to speak thier "native tongue" in school, then go back to the "native" country. My kids both go to Catholic School. It's a privledge and an honor. And by the way, most of the catholic faith do NOT speak Spanish. The foreigners that founded this country did speak english.

Hey 3: I am certainly NOT a redneck and embrace diversity. However, our Constitution was written in in English. I don't think the school is saying to outlaw the language. The rule is to speak English at school and whatever parents want to teach them at home is fine. This is a PRIVATE school and is a privilage to attend NOT a RIGHT. If they don't like the rules, they can pull their kids out and go to public school. These kids were also making fun of other kids in Spanish. That isn't right. What are these families teaching their kids?

Man, this is really ridiculous!!!! What is the problem with kids speaking their native tongue?? Isn't that what they're pushing nowadays, to be bilingual??? The only "bullying" going on here, is the school bullying the children out of their heritage. This country was founded by foreigners, the rednecks here in Kansas seem to forget that. Yes English is our national language, but it's not against the law to speak another language. I hope these people win. This is discrimination in it's dumbest form, and St. Anne's deserves to be sued!!! They should be ashamed of themselves. A good portion of the Catholic faith worldwide speaks Spanish!!! Shame on them!!!
