A teacher at Augusta High School submitted his resignation to the school board last month.
Police finished up their investigation Monday and they believe they have enough evidence for the county attorney to file charges against the teacher for unlawful sexual relations.
The Augusta High School teacher has been accused of having sex with a 17-year-old student. Police have been investigating this case for about three weeks.
The teacher was placed on leave immediately following the allegations, but resigned a day later. If the county attorney files charges, it is a level 10 felony.
"It would be a felony charge if the county attorney felt like we did a good enough job," said Tyler Brewer, Augusta police chief.
State law is very clear on this. It states that it's a felony for a teacher to have sex with a student under the age of 18 years. The county attorney should get the police report by the end of the week, so charges could come as early as next week.
