A persistent critic of Kansas Secretary of State Kris Kobach is short on time to reverse her apparent loss in a Kansas House race as a dispute between the two heads to federal court.
U.S. District Judge J. Thomas Marten scheduled a hearing Wednesday afternoon in a lawsuit filed by the Republican secretary of state last week.
Kobach wants to bar Democratic incumbent Ann Mah and GOP challenger Ken Corbet from contacting voters who cast uncounted provisional ballots in the 54th House District.
Mah trails Corbet by 44 votes out of nearly 11,000 cast in the Topeka-area district.
Ahead of the hearing, Marten ordered the candidates Tuesday not to contact 131 voters included on lists released by Douglas and Shawnee counties.
County officials plan to certify election results Thursday.
