A Kansas Court of Appeals judge, a district judge from Lawrence and an Overland Park attorney are finalists for a seat on the state Supreme Court.

The vacancy will occur because Chief Justice Kay McFarland plans to retire in January.

The finalists are Court of Appeals Judge Tom Malone, Douglas County District Judge Robert Fairchild and attorney Dan Biles.

The Supreme Court Nominating Commission picked them from among eight applicants, after interviewing them yesterday.

Gov. Kathleen Sebelius has until Jan. 12 -- the day McFarland leaves office -- to name the new justice. It will be her fourth appointment to the seven-member court.

McFarland will be retiring after more than 31 years on the court and 13 years as chief justice.
