Court Inaction Could Return Gay Marriage To California

The U.S. Supreme Court's forthcoming ruling in a gay rights case from California is likely to bring same-sex marriages back to the state.

Legal experts say how the court makes that happen and how many couples would be eligible to wed and when remain open questions.

The justices heard arguments on the constitutionality of California's ban on same-sex unions. Observers think the court might dismiss the case without reaching a significant decision.

Some scholars and lawyers involved in the case say that would let stand the lower court rulings that invalidated Proposition 8 -- and clear the way for gay marriages to resume.

Others think only the two couples named in the original lawsuit challenging the ban would be able to marry without more lawsuits.
