May 17 - A three month old baby is hurt, and police say she's the victim of a battery.

Wichita police were called to a home in the 2600 block of south West Street early Monday morning, on a report of a baby not breathing. That baby is now in critical condition at Via Christi-St. Francis Medical Center. The mother's boyfriend is in custody.

It was just before 3:00 a.m. Monday when John Werth's neighbor came looking for help. Her three-month-old baby girl was not breathing.

"She was hysterical." says John Werth. "She was pounding on my door so bad I thought she was going to break the glass. I ran over there and me and her boyfriend tried to resuscitate the baby, but she was already blue."

Investigators won't discuss the baby's injuries except to say they are significant. They believe the mother's 18-year-old boyfriend is responsible, something that doesn't sit well with those who know him.

"He's a gentle guy. He adored that baby even though it wasn't even his," says Werth.

After being interviewed by investigators the boyfriend was arrested for aggravated battery. But charges against him hinge on whether the baby pulls through this.

Wichita Police Lieutenant Tom Bridges says, "She's still with us and has been with us for almost 12 hours now. Obviously she's a fighter and still putting up that fight."

John Werth says he didn't see visible signs of injury on the child, but police won't say whether they believe this is a case of shaken baby syndrome. The baby remains in intensive care.
