TOPEKA, Kan. (AP) -- Governor Sebelius believes the gambling bill she's about to receive from legislators is constitutional. The bill permits large, hotel-and-casino complexes in four areas and slot machines at dog and horse tracks in three cities. It passed early yesterday, and she plans to sign it.

The constitutional issue is about who owns and operates the new
gambling -- the state -- and who handles the day-to-day management
-- private companies under the bill.

The Kansas Constitution requires gambling to be part of the state owned and operated lottery. But critics say it's not really state owned and operated if private companies manage it.

The Prairie Band Potawatomi tribe, which operates a casino north of Topeka under a compact with the state, has promised to sue.
