A protest of police action is underway after a weekend shooting outside a Wichita club.

James Ware was shot several times by police and remains in serious condition at Wesley Medical Center.

Protesters, including friends of Ware and witnesses of the shooting, say they only want justice for Jay.

The shooting happened early Sunday morning outside Max's Club at Harry and Rock Road.

Police were called to break up a fight in the parking lot. Officers say 34-year-old Jay Ware pulled a gun and pointed it at them. Three different officers fired, all hitting Ware.

Witnesses say Ware was unarmed and shot in the back.

Police did confiscate a weapon from the scene.

The KBI is still investigating the case to determine if the shooting was justified.

I just love the fact that people, who have no clue about what happened, decide to say stuff like "he deserved it", "they should've killed him", "he's a gang member", "he's a thug" or even my favorite "he had the gun fully assembled and was waving it at everyone". First off, how do you know what happened? Were you there? If not, you shouldn't say anything. An update on Jay, he's home and surrounded by family & friends. The big guy is moving just a little slower, but, he's still the same big ol' smiling, happy-go-lucky, gentle giant. Oh! So what if he was in jail. It was for something minor & is no longer on his record. To reiterate what someone else said, if Jay really did do something wrong, why's he at home and not in jail? Hmm. Guess that means the cops know THEY screwed up. I hope Jay sues the hell out of those 3 officers and anyone who tries to cover up for them. I can't wait until all of this is over. I'm tired of ignorant, misinformed people talking trash on a really good person.

ICT Resident- I will do no such things, especially since, whether or not he spent a night in the county jail doesn't wouldn't prove your point, ie. that he has a criminal record. Take your time and think about that one, and when you're done with that, consider trying to stop demeaning someone who never did you or anyone else any wrong. Peace. Peace.

3 officers made the same decision at the same time to shoot. Wierd, sounds to me like they all faced the same threat and they reacted. I am in the military and never carry a weapon away from the job and most in the military certainly do not. A drinking establishment is no place for weapons of any sort. A smart military man should have known better, but then again, we are talking about the air force.

I am from Wichita and still live here. I'm NOT from GA,MI or Mulvane.. THANK YOU WPD for doing your job!!! Dont think for one minute any of these officers came to work that night just wanting to shoot somebody. The officers did what they were trained to do STOP THE THREAT and go home at the end of their shift Bottom line the officers had a job to do too. I have to ask why in the world did he have a gun there with him at the bar? Military man or not he shouldnt of had one at Max's.

First of all, you should never pull out a gun or flash it, specially if the cops are around you, and you're the one causing problems. I think Jay was Stupid and that should teach him a lesson. If I was the cop I would fire first because I'm not going to let him assemble his gun and take his anger out on innocent people around me. Jay could of handle this situation a whole lot different by just walking away. Go home, instead of trying to be a "G" and pull out his gun to show off. This is not racial profiling and I'm tired of certain people always bring it up.

I was always next to the MAxs on hydraulic they had a couple shootings in the last 2 years, nothing like some of the other clubs in town, and not one happened inside. Get the facts straight. Also Jays Ar was not even assembled mmmm probably because there was no intent to use it. I dont know where him getting kicked out of the air force came from but hes still active military. For the peopel posting how they should have killed him and whatever else your saying, have you no ethics, his family reads this children read this GROW UP... Accept the fact this was a highly respected man and that WPD was wrong, it happens they will have to answer for that. Dont you think if he had really done this he would still be in police custody??????????????? Get your facts Wichita.... Racial profiling is real and it happens right in front of your faces.....

Thats a stright out LIE I was in the same pod with him in county jail back in 2006 I seen his picture on TV so I know it was him . If we are going to state facts lets get them Right. I spoke with him then and he said it wasnt his first time being in there. Since then I have changed my life and stop drinkin and druggin. But let me tell you he was know angel. Sheesh yourself....

To the concerned citizen from Detroit. You can look up statistics from Max's Bar when they were at Hydr. and Morris on the city's website.Being from Michigan I guess you wouldn't know about that. And why am I a bigot? I guess according to you police can do no right, a black man can do no wrong and anybody that says otherwise is a bigot. The only bigot in our conversation is you. You jump to conclusions and lay a brand to me merely because I support the police. Since you're out of town I bet you didn't hear about the 4 WPD cops that have been shot in the past year. One almost fatally less than a month ago. Your double standards and race crutch are tiresome. Folks like you distract from true rasicm that gets lost in all the wolf crying. What about the black man gunned down in his own driveway by another black man 2 days after the police shooting. Where's the outrage there? Why aren't people protesting in front of gang members houses with signs? Because they would need police protection.

He didn't have the gun at the bar. He had it in his truck (where he always keeps it because whether you like it or not, he is a MILITARY MAN) outside of the bar, again, fully disassembled with the ammo locked safely away in his glove box. There was absolutely zero intent to shoot anyone on his part. I know this, because I've spoken to him and because he's a good Christian man, I believe him 100%. Oh, and for whoever said something about 350,000 people in Wichita and only 30 people at the protest, the reason for the low number is because people had to work and many of Jay's friends and family members were either threatened by their jobs that they'd be fired if they were seen there or they had other reasons. If you don't know Jay or anything about what happened, then shut up. You all are showing ignorance by assuming you know the truth. The only people that know what happened are Jay, the police who shot him and the patrons who witnessed the incident. Unless you're one of these, SHUT UP!!

All the talk of conspiracy, rasism and police brutality. If Jay was white would we be having this debate? What if all the officers had been black? Why would 3 officers decide to execute a man infront of a p.lot full of witnesses for the heck of it or out of racial hatred? And what are the odds that this "unarmed victim" would just happen to have an assault rifle in his vehicle after being gunned down by the "evil police" in cold blood as many of you allege? As I said before they must be very fortunate crooked cops. And I asked before and nobody has or can answer, WHY DID HE HAVE THE RIFLE AT THE BAR?!And don't tell me it's because he's a military man. So am I and a club is not the place to have a gun unless you have bad intentions. And as far as the repeated comments about Jay not having a record (which I guess excludes him from ever being able to commit a crime) neither did Dennis Rader.

Police Supporter- What sort of statistical evidence do you have that Max's is any more of a thug bar than any place else. Again, your profound bigotry leads you to caricature black-themed bars as "thug" bars, while giving a pass to the other problematic, white-themed bars in the city. Further, I don't think the cops necessarily have to be crooked to use excessive force. "Why blame malice when stupidity will do?" as someone once said.

White- The race of the officers does not matter. I know this may be news to you, but black cops profile blacks too, and it doesn't make it "not racial profiling", even though it's intra- and not inter- racial. Further, even these police-biased media outlets are having trouble supporting the notion that a)jay was warned in any way shape or form b) that jay's gun was even assembled and c) that he pointed a gun at the cops. for those ignorant of guns, automatic means full automatic, machine gun style. some people refer to a semi automatic or one that only fires nce when you pull the trigger as automatic. some assume that since it looks military it is a full automaitc asault rifle. looks are decieving. the police got a load of surplus m 16 full auto asault rifles last year from homeland security. of course it wasnt that one that they showed on tv.

(There is absolutely no way on earth the NAACP would sign such drivel.) James 'Jay' L. Ware II is a well-respected, good, sane man without any criminal history or history of mental or emotional issues. He's a 15-year military veteran and a pillar of his community. One of things the anti-Jay posters are consistently doing here is displaying their profound bigotry toward Jay by characterizing him as a gun-totin', drunkard thug, really caricaturing him. Jay did not have a gun in his hands!! He did not even drive his truck to the club that night he was on his bike!! The police took the gun that they assembled out of jays truck (his sister drove it that night). He was shot my ignorant barney cops!! They will have to be accountable for their actions. I am not in the military, but my family and friends are. 1st they do not carry around assault rifles where every they go. 2nd I am sure they do not take them to night clubs with them. That is because they are family men and women, and have no reason to go to gangsta clubs. They are busy being there for there kids and family's.Here is a hint stay away from known places that this crap happens.Save everyone a lot of time and tears.Also for the person who said where are the police, Club Rodeo is a little bigger than Maxs club. I am no genius but the more people you have in one place you will have more problems. Whoever said where is the police you are telling me you know there is a need for them there. I wasn't there that night and have never been to "Max's" but my question is regarding the police offers that shot at Jay. Three police fire at a man who supposively had a assault rifle, the man was only shot FIVE TIMES and a bystander was hit in the foot! The shot in the foot sounds like an officer fired to early as he unholstered his/her gun (you shouldnt have your finger on the trigger while unholstering). Seems to me that the WPD should retrain there officers on marksmanship. As a gun owner and NRA Member I personally think its scary that our police, who protect us, are that bad of marksman. Hopefully they were the 3 worse marksman on the force!!!!!!!! Also, IF Jay did have an assualt rifle, and IF he retrieved it from his car I believe they had every right to fire at him to protect themselves (even if he didnt point it at them), he could have shot a civilian w/o pointing at the cops. Then we would have another type of protest in our city about Cops not acting soon enough.

I have to respond to "E" 08-07 0859PM. Jay does not have a gun just like the police. He has a much more powerfull gun than the police. See patrol officers do not have rifles in WPD, for whatever crazy reason, only SWAT officers have them. Also WPD is not allowed to run w/lights and sirens to any call except an officer in trouble. And the question still remains why did he have an assault rifle at a bar? And though Jay may not be a gang member or a thug he was hanging out at a thug bar, again w/an assault rifle in his car! Officers have a split second to make life or death decisions for themselves as well as the citizens they protect. The fact is Jay took a rifle to a thug bar and was shot when he pointed it at police. These protesters have all day to armchair quarterback the officers who, of course, shot the poor unarmed African American in the back. They must be the luckiest crooked cops on the planet to shoot an unarmed man that just happened to have a military type rifle in the trunk.

thanks for your remarks, wpd. now how much of this would be going on if there were dash cams on police cars? what would we find out if the records of those loudest in not wanting dash cams were lookid into? of course that wont happen, because police records arent public, they are kept secret. the only word that he had an "assault rifle" out is from who? wittnesses? or wpd. are we to take as absolute truth any thing said by someone with a badge?

You seem to be too intellectually to challenge the implicit assumption that a) Jay even had the gun assembled b) he pulled it out. Stop congratulating the WPD blindly, when the only thing we know about the character of those involved is that a) Jay has *NO* criminal record and *still* hasn't been charged with a damn thing and b) he is a well-respected, 15-year military veteran, a pillar of his community, a role model, and intelligent person who would *never* point a gun at the police. Maybe if it was you who was the victim of excessive force and a trigger happy (yes, a couple dozen shots does constitute trigger happy here) set of officers, you'd think twice before posting such drivel.

i dont know all the facts but, to me it seems that if only one officer was shooting, it may be poor judgment, but the fact that all three officers fired in front of many witnesses tells me that it was not misjudged and that fireing at the gentleman was an act of instinct to protect themselves and the people of wichita. if i was an officer, i would not give no Man or No Woman the chance to touch a weapon of any sort. and im sorry but you do not need an automatic rifle to protect your self, unless your planing on getting in to a bunch of trouble, and if thats the case, stay home. its wichita not iraq, leave the automatics at home and enjoy your life. if you realy think you need that much protection then maybe your hanging with the wrong crowd.

People dont think Maxs is a thug bar. Are you not watching the news, When Maxs was on south Hydraulic and morris street it had a lot of shooting and violent crimes occuring at the bar, that involved gang members. Thats why he had to move it to another location. Maxs is still owned by the same person. I hope the people who fall victim to the bars thug life sue the the bar owner for all he's worth. The real criminal is the bar owner, and the thugs who attend. I hope the citizens in that area fight to get the club and owner gone. --- Justice for Jay what is that, you bring a rifle to a club you only have one thing on your mind.. to kill. The police saved many people from falling victim to Jay. If he was such a good guy why was he kicked out of the Air Force? Justice for Jay is him being locked away in Jail. Thanks to those who gave their time to PEACEFULLY protest. Let’s analyze this from a realistic standpoint. Is it possible to completely surround a man with 3 police officers in a full parking lot? Jay, a highly respected young black man who serves his country with pride was shot IN THE BACK by WPD! Second, in regards to the comments about Maxs being known as a “thug gang member hang out”, I question if this person has been there or is making a racial assumption. Clearly you have never seen their security enforcing rules for the safety of their patrons and the community. Jay is a career soldier (17 yrs), which could explain the military rifle in his possession. Jay, who was an enlisted Airman made it to a very respectable rank; which can be difficult to attain and was only a few years from retiring with full benefits, doesn’t sound like a drunk, thug or known gang member. STOP racial profiling! My prayers are with Jay and his family and the city of Wichita.

I know Jay and used to work with him @ max's when he provided security there. He is a good man with common sense, not the type to just pull out an assault rifle on a crowd of people. I wasnt there so I am unaware of the circumstances. I pray for his speedy recovery and hope the investigation will result in his favor. I'm glad to hear people were involved in a peaceful demonstration concerning this matter. May God bless and care for you all!

Jay is a really nice, wonderful guy. Some one isn't telling the truth.Jay wouldn't do something to mess-up his military career.Jay fights to keep me free- that makes him one of my heroes. To his family & friends: Had I known about the protest, I wouldn've been there to show my support. Please tell him our prayers are with him.

Ramsey, Jay is a crimminal. He is not a cop, he had and automatic assault rifle at a night club that is illegal! I don't care what kind of man he is or had been in the past, he was a criminal that night. And for the record....war veterans are honorable for serving our country in a time of war, but that doesn't make them good people when they get home. If Jay wanted to carry a gun to shoot people to protect the community he should have been a cop, but he wasn't, and he chose to break the law.

You're right, I am sure the WPD wait around doing nothing until someone commits an offense and they can go shoot them for not reason. I am sure that is what happened, poor man with an assault rifle, drunk, angry and not listening to the police, he is such a victim. He had an ASSAULT RIFLE at a bar got in a fight, and went to his car to get it. Tell me.......at that point should we have let him shoot, bystanders, police officers, the man he was fighting with, himself, all of you smart people leaving sympathy comments choose who you would have liked to have seen be lit up. The police protect and serve.....YOU! I hope you are never in a situation where you need a cop to shoot a felon, your remarks might change a little if your life was saved. Maybe if more people had consequences for their actions, and less people were stupid about critizing the law and supporting the criminal we would have less crime......interesting huh?

If they had wanted something bad to happen they would have let the guy kill someone or several someones. Then there would be a vigil to 'stop the violence'. There are a LOT of STUPID, uneducated, and uninformed comments flying around. For the record Jay is a CAREER MILITARY MAN! NOT a THUG or a gang member or even a violent person! He owns the EXACT SAME TYPE OF GUN AS THE POLICE! "Why?" you ask, because he is a SOLDIER and his way of life is to protect the United States and OUR freedom!So HAD the police announced their presence, lights, sirens, vocal commands, ANYTHING, they would have been briefed by Max's security as to who the trouble maker's were and they could have helped control the crowd and dispersed the patrons peaceably! Instead, they see a 6'3" black man in the trunk of a suburban and ASSUME he is the enemy. Simply taking 30 more seconds or saying they were there and ALL this crazy crap could have been avoided!

Thanks to everyone who joined us today. To the person who lost their son, I feel for you, & because it was a black man doesn't warrant a racial conflict. The fact that Jay was an unarmed black man shot by 3 white cops does raise some racial questions. He was not surrounded by the police because they were all behind him. MAXS isn't known for gangs or shootings, so that comment is ignorant. Drama is evident everywhere you go. He didn't put himself in that situation. He's not dead, so there's no coroner report. Not every person who witnessed the incident was drunk. And for the last tme, Jay is NOT a criminal. He's a war veteran, a family man, a pillar of the community and a man who'd gladly give you the shirt off his back if you needed it. I have 2 questions for the police. Why were the people who started the whole damn incident allowed to leave without being questioned or searched? Why did the cop who fired the first shot into Jay's back quickly get told to leave by the other policemen?

This is to Jade. You just remember that all the shootings and damages were done only by the cops. Do you know every club and bar has shootings, stabbing, fights? Club Rodeo recently had a major fight inside, and shootings, stabbings, and rapes? Does the City of Wichita clasify Club Rodeo as a Violent club? No, instead WPD makes sure they are out at Club Rodeo's parking lot partoling every weekend. Were there any WPD at Maxs on Saturday night for parking lot control? Not a single cop until Maxs called for parking lot control after the club closed. Why does WPD voluntarily go out to Club Rodeo for parking lot control and no single cop at Maxs? WPD wanted something bad to happend at Maxs. Tell me why.

ok white man beat in jail not that big of a scene. but black thug shot by officer and it is because he is black right? well guess wht this aint the twentys so wake up someone points a gun at me then they will be shot no remorse why would he have a gun like that even near the scene it is because of scum bags like that getting my rights to bear arms limited even if he didnt piont the gun why is a RESPECTABLE citizen that wants to be able to carry firearms be at a GANG bar up to no good.

A report came out that the three officers were: one black male, one white male, and one female. Why did this man have an assault rifle? Why was he at Max's? You can contact Nancy Grace and Bill O'Reily, but I think they tend to side with the law and not sure you'll have much empathy from them.

Three officers tell this guy not to go to his car, they follow his movements all through the process of his gun retrieval. After defying law enforcement he pulls out a gun... I wonder what a guy at a bar involved in a parking lot fight needed a gun for? Seems to me that you don't have to turn around with the gun in your hands to prove your intentions.

What was Jay doing with an assault rifle at a bar? This weapon has one purpose, to kill people. Do the police just sit and wait for him to start shooting people with the rifle, before they shoot him. Then we would have protests that the police did not protect the patrons in the parking lot, because they were black. If you are at a bar with an assault rifle, nothing good is going to come out of it.

Not everyone was drunk there that night...we have plenty of employees there. Noone is pulling a "race card." Facts are facts. Ignorance has always been bliss when it comes to these issues though! Thanks to everyone supporting our cause! By the way, you can say whatever you would like because it will not make me lower my standards or intelligence to come to an ignorant level with those who were not even there the night of the event.

Here we go again, poor black person shot in the back. If he had a gun and was pointing it, he should have been shot. Why do we always have to play the race card. When our son was killed the young man that ran the stop sign was black. Our son was white and the black guy got no jail time. And no one wanted to report about it. So come on and lets all grow up and quit playing the racist card everytime someone black is shot. I personally don't think this is national news. Come on KAKE there are other stories that deserve time on the air also.

He was "surrounded" by police when he was shot so it is VERY possible that he could have been shot in the back by a different officer than the one he pointed the gun at people!

I'm very curious to hear what the coroner's report says. It should be apparent from the autopsy whether or not he was shot in the back. Unfortunately, drunk people outside a nightclub aren't usually the best of witnesses.

Deb, please investigate and report on this fair and balanced. Please investigate why this man who police say pointed a weapon at them was shot five times in the back. We are also asking national news media such as Nancy Grace and Bill O'Riley to look into this matter also. If the man had truely pointed a loaded weapons at the police officers then it would be a total different story, however don't you find it a little hard to believe this is truely what happen when the man was shot five times in the back?????
