A Wichita family says a mistake by a local hospital killed their loved one, and are filing a wrongful death lawsuit.

Tim Dieker's family is taking legal action against Via Christi, asking for damages of several million dollars. The family says Dieker died because of a horrible mistake.

Dieker was 41 years-old when he was admitted to St. Francis Hospital on July 16, 2006. Four weeks later, he died. In the wrongful death lawsuit, Dieker's family blames the medical staff for his death.

The suit claims gross negligence, inattention, and recklessness... saying Dieker suffered horribly before his death.

"There is no justification for a medical error," says Don Anderson, an attorney for the family. "Especially under these circumstances."

According to the hospital report written by the operating doctor, surgeons were doing a lung biopsy on Dieker to see if he had an infection. The report says the doctor was handed a syringe that he assumed contained Lidocaine, an anesthetic that he ordered.

The doctor injected the medicine into Dieker's lung. That's when the report says the patient began to cough violently. The nurse then discovered she had inadvertently drawn formaldehyde into the syringe instead of Lidocaine.

"When formaldehyde is injected into the human body it's very dangerous," says Anderson. "It is deadly."

Via Christi officials declined to comment, saying it's premature because they haven't seen the lawsuit.

KAKE News obtained Dieker's autopsy report, which shows bacterial pneumonia in his lungs consistent with Legionnaires Disease. The report does not mention formaldehyde.

You bloggers have no idea what you're talking about. This occurred during a bronchoscopy that the patient had to determine the cause of his life-threatening pneumonia. The biopsy is placed in formalin to preserve the cellular architecture for the pathologist so an accurate diagnosis can be made. It was a mistake and was investigated properly but is unlikely to have made a significant impact on the patient's illness, since he had relapsed leukemia with <5% chance of survival, and the pneumonia was Legionnaire's disease. Furthermore, he died of a massive brain hemorrhage from lack of platelets--the formalin had nothing to do with it, but far be it from KAKE to let the facts get in the way of a good story!

You sue the hospital because it employed the nurse and, as such, is responsible for her behavior during the course and scope of her employment. The hospital also has the money or insurance to pay a judgment whereas a nurse does not. Yes, the nurse should be disciplined by the state board. Did anyone bother to report her conduct? This is why I stay in California. I'm not picking on Via Christi. It's just as dangerous at Wesley. Poor Mr. Dieker and his survivors! I hope they win a bundle from St. Clueless.

Why on earth would you have formaldehyde in the operating room? Might as well have Kevorkian as your gas passer

Formaldahyde is a horrible toxin yet vaccine manufactures still place it in childhood vaccines. This is what the use to embalm people after they have died. It is not for a living human being.

Forget the lawsuit, Via Christi and the nurse need to just cough up the money they owe the family and the nurse needs to at least lose her license.
