An early morning car-train collision kills one man and leaves another in critical condition. The accident happened at 31st Street South and K-15 near Cornejo and Sons.

This isn't the first deadly accident at that same railroad crossing.
In the last 6 years 3 people have been killed when a train and car collided.

Now, a Kansas lawyer says all of these deaths could have been prevented.

"It's like no one has stepped up and taken responsibility for the safety of this intersection. They all say it's someone else's responsibility," says attorney Rachel Mackey.

She filed suit on behalf of Reyes Rivera's family. He died in September of 2005 when a train struck his truck at the same intersection. Mackey is alleging negligence on behalf of the railroad and Cornejo. Mackey says they knew how dangerous the intersection is and never installed flashing lights and crossbars.

The Kansas Department of Transportation says it was the railroad's responsibility to make the intersection safe, but because the street was owned by Cornejo, KDOT could not step in, until last year.

KDOT has just finished a study and says there is enough train and car traffic to install flashing lights and gates. They should be put in place in about a year. Mackey says it's too late.

"If there were lights and gates, that young man would probably still be with us," she says.

My previous comments have nothing to do with legals or illegals. They had to do with people in general. If this man was so tired he couldn't see the train he drove by he shouldn't have been on the road, I don't care where he was from.

AMEN, to welll now! I'm amazed at how some of our fellow citizens can turn ANYTHING into an immigration problem. You people DO realize you're being prodded to be so upset about a "problem" that's been with us for decades, right? If you've decided in the past year that illegal immigration is one of the gravest situations facing our nation, YOU'RE A PAWN! I'm imploring you to step back and think about it. They've redirected your attention from the truly important stuff.

This crossing is not an intersection, it's a driveway to a business. There is absolutely no reason why the people who work there and use this company cannot look both ways for a train. There is nothing that blocks the vision to an oncoming train in either direction, except a driver laziness to look or his/her OWN FREE WILL to be stupid and try to beat a train. I work in a law firm and would be embarrassed to take a case like this because of the stupidity that was involved on the driver's part. I do, however, feel sorry for the Engineers who must now live with the fact that the train they were in charge of killed someone. The Engineers didn't do anything wrong and they will now live with the worst of it. It's time for these drivers to take responsibility for themselves, open their eyes, and use the brains God gave them.

this comments are so cruel, I can remember several train incidents with american people killed, and they could read the signs, I hope you never see yourselves or anyone on your family suffering such tragedy...God have mercy on us...

Jesse Conejo started as an illeagle, worked hard, saved enough to buy a pickup and started hauling trash. from that he built up his buisness to what it is today. and yes, he got his papers and citizenship as well. Now thats a sucess story.

there are a lot of dangerous crossings, why can a buisness get a signal so fast when residential areas wait forever, if then?

That young man had just got off work at 6am from a 3rd shift job and was going to work the whole day at Cornejo. He, like many other "Illegals" have to work 2 jobs to support their families back home and survive here...When are you gonna see an American doing that?? If it wasn't for the "Illegals" we wouldn't have streets to drive on,they are the only ones who will stand out in the hot sun all day for low pay. We need to applaud these people. Sacrificing theirselves to survive and have a better life in USA, when most of them have children back home that they never see grow up...just so they can have clothes for school,food to eat and shoes to put on their feet. The people of the United States need to quit being so judgemental and take a long hard look at theirselves!!! Oh,and that young man had just purchased that car 2 weeks ago,just to be able to go to work!!! How tragic his death was!!

Hmmm...prevented huh. Tell the lawyer that they can be prevented by paying attention to the crossing and obeying the stop sign that is there. It is not like the train can steer into the car. I love how it is always "somebody else's" problem. How about "if that young man were paying attention to road signs and conditions, he would still be with us."
