Attorneys To Argue Over Release Of Holmes Records

A judge will hear arguments about whether the Colorado theater shooting suspect's university records can be turned over to prosecutors.

At issue are 100 pages of non-medical records relating to accused shooter James Holmes' doctoral studies at the University of Colorado. Prosecutors want the documents to help them make their case that a notebook Holmes sent to university psychiatrist Lynne Fenton should be allowed into evidence. It reportedly contains descriptions of a violent attack.

Holmes is charged with killing 12 people and wounding 58 others in a July 20 shooting at an Aurora theater. He is expected to attend Thursday's hearing.

Defense attorneys say Holmes' school records are subject to student privacy laws. They say the notebook is protected by a doctor-patient relationship.
