An appeals court has upheld a conviction of a man charged with raping an elderly woman recovering from surgery at a Salina hospital.
Paul Parker, Jr. was convicted of sexually assaulting a 94-year-old woman in 2010.
The Salina Journal reports Parker appealed his conviction based on several errors he claimed were made in the case, including refusal of his motion for a change of venue because of extensive media publicity.
The appeals court ruling stated that Parker's request for a pretrial public opinion poll was properly denied, since the court planned to take extra precautions to ensure an unbiased jury.
