This is an important workers compensation case involving a worker who was fired by an employer and the employer is trying to claim that he should be denied workers comp benefits even though he told his employer about his previous history of injury.
The employee made one mistake in a document and the employer’s workers compensation attorney discovered this mistake and communicated it to the employer, getting the employee fired.
The Kansas Workers Compensation Appeals Board says that this mistake makes no difference and the employee is entitled to workers comp benefits for being fired. The Employer is appealing this decision.
