Brooke Dinkel, the Smoky Valley school counselor accused of having sexual contact with a 13 year-old student has made her first appearance in court.

The 31-year-old appeared by video this morning and was officially charged with 10 counts of rape for having sexual intercourse with a child under 14 and two counts of aggravated criminal sodomy with a child under the age of 14.

The Saline County Attorney's Office is prosecuting the case because the crimes are alleged to have occurred in Saline County. The Saline County Attorney's Office says the original charges Dinkel was arrested on were changed after reviewing the case.

The next scheduled hearing in the case is scheduled for April 22.

UPDATE: Monday, April 1, 2013

The superintendent of the Smoky Valley School District says they started looking into accusations against a guidance counselor at the middle school on Wednesday. Soon after, they called police.

Thirty-one year-old Brooke Dinkel has been the school counselor at Smoky Valley Middle School less than a year but right now, she's not allowed in the school.

"I want people to understand that Ms. Dinkel has been suspended from our school and she will not have contact with our students,” USD 400 superintendent Glen Suppes said.

Dinkel was booked into the Saline County Jail Friday on five counts of rape and five counts of aggravated criminal sodomy, all with a child under the age of 14.

Investigators say the victim is a 13 year old Smoky Valley Middle School student.

"We want to do everything we can to protect our young man in this very, very unfortunate incident as well as the parents,” Suppes said.

The superintendent originally called Linsdborg police but the Saline County Sheriff tells us the case was turned over to them because the victim lives in Saline county and Brooke Dinkel lives in Salina.

The news is hard to believe for parents and people who work for the Smoky Valley School District.

"I'm shocked just because it is a small school district. The students, the parents are really involved, the teachers are super involved,” Raeanna McMannis, substitute teacher for USD 400 said.

Brooke Dinkel has been suspended from the school but the superintendent says no matter the outcome of this case, she won't be coming back to USD 400.

"A couple of weeks ago, she had resigned from the district. The suspension is in full force. I don't see anything changing there. She will not be back at Smoky Valley School District,” Suppes said.

A north-central Kansas school counselor has been arrested, accused in the rape of a juvenile.

According to KSAL Radio in Salina, 31-year-old Brooke Dinkel turned herself in on Friday and was booked on 5 counts of rape and 5 counts of criminal sodomy involving a 13-year-old boy.

Dinkel is a counselor at Smoky Valley Middle School in Lindsborg, located in McPherson County, and the victim is a student at the school. She was arrested by Saline County authorities because she resides in Salina, and the victim also lives in Saline County.

The Saline County Sheriff's Office became involved when they were contacted by the Lindsborg Police Department last week. Investigators believe the incidents took place from October of last year until March.

Formal charges are pending
