A suspected burglar is being treated at a Wichita hospital after being shot by a homeowner early Wednesday morning.

It happened around 3:30 a.m. in the 1000 block of East 149th Avenue North in rural Mulvane.

According to the Sumner County Sheriff's Office, the man who lives at that address woke up to sounds coming from his attached garage. He went outside to investigate and found a man inside.

The homeowner held the suspect at gunpoint while his wife called 911. Investigators say the suspect then attacked the man, and one shot was fired.

The 31-year-old suspect was shot in the upper chest and was flown to a Wichita hospital where he is currently listed in serious but stable condition.

The homeowner has since been interviewed and released while the investigation continues.

Captain Mike Yoder from the Sumner County Sheriff's Department says the homeowner had every right to shoot the burglar by Kansas law.

"There was enough of a threat that put him the homeowner at risk," said Yoder.
