Reginald Carr's lawyers want to move his trial out of Sedgwick County. And it's all over an ad you might have seen on T.V.

It's a commercial supporting Phil Kline for Attorney General. Wichita T.V. stations, including KAKE have pulled the political ad, because of this statement:

''Reginald Carr, who murdered four people after his parole was cut short."

Reginal Carr is accused of murder, but has not been convicted. He hasn't even gone to trial yet.

His attorneys are outraged. They filed a motion for a change of venue this morning.

Because Carr's attorneys are under a gag order, they can't comment. But one local veteran defense attorney had much to say about a statement like that could taint a jury pool.

Defense attorney Warner Eisenbeise says, "Absolutely, I think it could affect a trial. That ad says he's a murderer, that quote he's a murderer."

Kansas Governor Bill Graves is also attacking the ad not only for it's Inaccuracies, but because it was produced out-of-state.

Graves says, "This one troubles me greatly, because it's people we don't know where it came from, we don't know what they want."

The Virginia non-profit organization wouldn't return our phone calls. A Kline campaign official says this:

"We have no say over what's in there. We have no control, we just don't know. Ii have no idea why the group picked this issue. Ii have no idea why the group picked Phill Kline."

There's no Kansas law that requires a political candidate or campaign office to approve or edit an independently-funded ad.

The state ethics commission says Kansas does not have a "Fair Campaign Practices Act." In the past, lawmakers have considered legislation that would control out-of-state expenditures on campaign ads, but no new laws have been passed.

Reginald and Johnathan Carr are accused in Wichita's second quadruple murder, and the killing of cellist Ann Walenta. A judge will hear the Carr's motion to move the trial out of Sedgwick County on Friday.
