A man accused of using a camera to spy on women at a hospital bathroom, is found guilty. But after a plea agreement with the state he could deal his way out of jail.
Eleven charges of eavesdropping for 11 victims, all women working at Via Christi St. Joseph, and all unaware fellow employee, 36-year-old Timothy Nicholson was taping them in the bathroom of a co-ed locker room.
Nicholson was a maintenance man at the hospital between November of 2002 and March of 2003. That's when the crimes took place. Hospital officials found out what was happening and called investigators.
Nicholson was using the hospitals equipment without authorization to execute his crimes. Prosecutors say a hospital representative was willing to testify against Nicholson in addition to the victims. But because Nicholson changed his plea of 'not guilty' to 'no contest' there will be no trial.
The judge found Nicholson guilty. The woman will be spared the trip to court. But Nicholson could also be spared a trip to jail. As part of the plea deal, the state will ask for probation instead of jail time.
The chief operating officer for St. Joseph hospital said today he is relieved employees whose privacy was violated will not be subjected to any further discomfort, inconvenience or embarrassment a trial might have caused.
Nicholson will be sentenced on March 2. The state will recommend a suspended sentence and two years probation.
