Open range makes since if it's a "wild" animal.Nobody can own a deer.My 25 year old sister will never be the same because some man couln't controll his horse. If you can't controll your animals some needs to take them away from you.

Yes Kansas is an open range state. But the owner was trying to load the horse in a trailer and the horse got away from the owner and that is when Jessica hit the horse. Therefore it would be the owners fault. Who cares whos fault it was think of what her family is going threw right now especially her mother and father. The just lost their son a little over a year ago and she has two children and her oldest is 7 and the youngest is only 2.

Last I knew Kansas was an open range. So it would be considered her fault.

Bob, yes, usually the owners are at fault, unless he/she was at a boarding stable, then usually its the stables. Basically, whoever’s job it was to maintain protection and general well being of the animal is liable.
