To the people that think Mr. Gaines is a nice guy think again. I am a detention deputy at the jail. Since this man has been at the jail he has been nothing but troble. He has constanly made threats of bodily harm against deputies. For the people that think this sentence is too harsh. How would you feel if that was your husband that he spit on!!!! Remember the man dies have AIDS!!!!!!!!!!!!!!!!!!! And for the comment that said battery is a misdamenor. you need to learn your laws okay. Hitting a co in jail or prison is a felony. What weapons do I have besides a pair of handcuffs and a pair of gloves. You come supervise 52 to 56 inmates a day!!!
When are people going to grow up and take what they did like a man or women.Well this is a very mental and unstable criminal, you do not want around you or your family. Those mean policemen were rude to him. Shut up people, why don't you guys come and visit him and see if the judge will let him stay with you. I hear and see on the news bla bla was shot and killed, this is why this is happening poor criminals every one is out to get him and being mean to him. I bet is was doing nothing at all, better yet I bet those mean officers made the whole story up. I think we should let him go free. since they were so rude to him. No people life is not fair, people will do rude things get over it.
This man did spit in the faces of those officers but that was not all. There was blood present in this man's spit. My husband, one of the deputies, had scratches on his body as well as a few other officers. And to April, HIV may not be a "death sentence" as you put it but it absolutely is a life changing experience that in no way should happen. This man deserved longer than 13 years.
Defendants are not required to follow the Code of Professional Conduct for Attorneys, while prosecutors, in theory, are. Apparently Mr. O'Connor hasn't reviwed his copy in a while. Completely unprofessional behavoir. Unfortunately, it is not unusual.
Well for those that know Mr Gaines this is nothing new. This is his way of life. No communication skills of any kind. Never takes any responsiblity for HIMSELF AND HIS ACTIONS. When the judge asked him direct questions he would always shift the question around. Or even bring up another case not even related to him. But this courtroom outburst shouldn't have gone on as long as it did. It should have been terminated the first time he got disrespectful toward courtroom staff. They shoudn't have to put up with JUNK like that.
To April...yes even inmates have a right to privacy, however, the reason his HIV status is mentioned is because that is why he was charged. He knowingly had HIV and spit in the faces of 2 officers. These officers had to go through months of HIV tests and were put on "the cocktail" as a result..... This man has no sympathy from me. My husband is a deputy and had to testify at this hearing...this man threatened not only every one that was involved at the jail including my husband, he threatened to kill me and my son and the families of each officer involved. This "man" deserved more than 13 years if you ask me.
In response to the comments made earlier to my post, HIV is not a death sentence. My patients are living 30 years after diagnosis. Majority of my patients lives are taken from something other than HIV itself. Educate yourself people. HIV is only spread through blood, semen, vaginal fluids, and breast milk. Saliva does not carry the virus. It really saddens me that in the year 2008, almost 30 years after HIV/AIDS was discovered, that people are still uninformed. Is that why I keep getting new patients in my office? Educate yourself before you or someone you love falls victim to this horrible disease.
what a sad sad....thing this man talking to a judge that way! I would have put some electrical tape on his mouth!! I hope he gets a long time in prison!!
Obviously all of you are very misinformed about the HIV virus. IT DOES NOT SPREAD THROUGH SALIVA!!! Blood, Semen, Vaginal Fluid and Breast Milk only. There is absolutely no way this man could have spread HIV to the officers. Even if the saliva had a large amount of blood in it, it would have to enter through an open wound. I don't believe you should have spit on anyone, or cursed at the judge, but I agree with April, his medical information is private, and unless he disclosed it to the media, it should have never been released. No one is required by law to disclose their HIV status. You are only required to share that information with your sex partners and anyone you share needles with, that is the Kansas law. I think it is about time that people stop living in the 1980's and understand that HIV is extremely common and not a death sentence. Our current treatments are keeping people living 30 years and longer, that doesn't sound like a death sentance to me.
Kp, you say fact of the matter is he shouldn't have acted that way. You are right he acted like the criminal he is but the officers of that court acted in the same manner even causing it to become worse. The ADA, fact of the matter, should have been 100% more professional. The Judge, fact of the matter, also should have been more professional. I do not excuse the actions of the prisoner but I do expect that officers of the law be professional on or off camera. That prisoner could have been so wild up by the ADA challenging him that he could have caused harm to those officers escorting him out of the court room and it would have all been caused by a mouthy ADA and a judge letting it go on for too long. Being a judge or attorney gives them no right to act in the way they did. Your county has a clear record of inmate abuse that this prisoner from the tape sounded like had dealings with that same guard that caused that abuse.If you work with criminals you must be able to deal with bad mouth
Fact of the matter is, this man shouldnt have behaved the way he did. It doesnt matter how long they let him stay in the courtroom, he acted like an idiot, like the criminal he is. He should have gotten a lot longer than 13 years for having possibly infected someone with his disease because that is a lifetime sentence!
since he has hiv, spitting on someone could be construed as atack with a deadly weapon. thats why. hiv is still a death sentense for those with it. thats why he was in court, for spitting on deputies.
My concern is more with the fact the article stated the inmate is HIV . What does that have to do with the outburst in court? Isn't that the inmates private information? And yes, inmates do still deserve privacy regarding medical conditions. Who ever wrote that blurp should be ashamed of themselves. How would they like thier private medical information released to the world? Also, I must agree with Jo. Where was the professionalism with the ADA and Judge? The inmate should have been removed long before he was.
I am really upset at the actions of the ADA Kevin O'Connor and some of the judge. The ADA purposly aggrivated the situation with this prisoner, going as far as to challenge him saying "any time". I am not sure who was worse the criminal who you know or expect to act out or the ADA who should have been more professional. Why did the Judge allow for him to act as such. This tape shows exactly why people in general have a problem with what are suspossed to be professional employees
