The Kansas Supreme Court has ordered a new court hearing for a convicted drug dealer, saying he's suffered from bad attorneys.
Fifty-four-year-old Bobby G. Hemphill senior was sentenced in 2003 to four years in prison and three years' probation after pleading no contest to possession of methamphetamine within 1,000 feet of a school.
Hemphill later tried to withdraw his plea and appeal his prison sentence but was denied by a Reno County judge and a state appeals court.
The Supreme Court ruled that while Hemphill would likely fail on withdrawing his plea, he should be given a new hearing because of ineffective counsel.
The justices noted that one of Hemphill's attorneys argued against his client's motions and others haven't shown up for hearings.
