The woman charged with killing her five-year-old nephew in a car crash is back in court and headed for prison.

Redburn to Prison

Dec. 21-The woman charged with killing her five-year-old nephew in a car crash is back in court.

Misty Redburn plead guilty for the deadly crash and admitted to driving under the influence.

She avoided prison time and was given a probation sentence because her sister pleaded with the judge to give her a second chance.

Wednesday she's back in court for violating probation.

3 months ago Misty Redburn was able to walk out of the courthouse with her family.

This time things were a little different.

Redburn told the judge,"I used so I don't have to feel the pain."

Redburn was under the influence when she wrecked her car killing her 5 year old nephew Santiago.

Lizabeth Bonner and Tammy Casey witnessed the accident, pulled Santiago from the car., and performed CPR.

Its those images which brought them back to court on Wednesday
They wanted to be there and wanted to make sure justice was done.

On six separate occasions Redburn tested positive for illegal drugs, including methodone and cocaine.

Redburn lied to her probation officer and failed to show up for meetings five times.

Redburn was also supposed to get a full time job and perform 20 hours of community service.

Since the sentencing, she hasn't worked a single hour.

Redburn was given probation for involuntary manslaughter due mostly to the victim's mom, her sister, pleading with the court to give her a second chance.

This time she didn't show up to ask for a third..

Attorney John Kurns says Redburn is depressed and has serious psychological issues and asked for one more last chance.

But, it didn't make a difference to the judge.

"My own credibility would be at stake if I didn't follow through on my commitments as judge .When I say zero tolerance, that's what it means."

Redburn will go to prison for just less than three years.

That's not enough time for Tammy and Lizabeth, but prison time none the less.

Judge Ben Burgess plans to recommend Redburn be admitted to the drug and alcohol treatment program in prison.

That is, as he told her, if she's really serious about getting help.
