House Clears Way For Kansans To Own Machine Guns Save Email Print

Individuals could own machine guns, other
fully automatic firearms, sawed-off shotguns and silencers under a
bill the House has passed.

The vote today was 105-to-18.

The measure is the House's version of a Senate-passed bill
making it a felony to deface or remove serial numbers or other
identifying marks on a firearm.

A House committee wanted to rewrite a state law limiting the
possession of silencers, sawed-off shotguns and automatic weapons.
In December, the attorney general had issued a legal opinion saying
part of the law is so restrictive that only law enforcement
agencies can possess silencers -- meaning no dealer can have them in
Kansas, even to deliver to those agencies.

In amending the Senate bill, the House committee decided to make
it legal for individuals to own such guns. But they would still
have to comply with federal laws requiring background checks.

The House's change will become an issue when the two chambers
negotiate over the final version of the bill.

I actually think this is pretty interesting.... like one comment I've read, yes, a sub-machene gun (the MP5 for example) can do just as much damage as a pistol, often times SMG's use the same ammunition as well, and all it really takes is 1 shot... I also agree with him in that going to a gun range and firing a fully automatic weapon is probably alot more exciting than just a handgun or one shot at a time.... I also dare anyone to disagree that it would be alot less likely for your house to be broken into when the thief knows you have an automatic weapon.... If you have the money for it anyway.. And as for the common thief (the kind in Kansas), they won't be able to afford automatic weapons. Why do you think they need to steal?

You know, for all of you complaining that people may be able to have fully automatic weapons, and saying that you dont want to worry everytime you walk the streets that someone might have a fully automotic machine gun, they can do just as much damage with a single shot rifle as can be done with something fully automatic. I am a qualified marksman and sniper I am proud to say i only need one shot. But, i still might like to target practice and play with something fully automatic.

Some people really are dense and niave. Whether you believe it or not all the thugs and self acclaimed gang members are already carrying these weapons. this just makes it legal for the law abiding citizen to own these. not everyone is morbid, i like to go target shooting, and i myself wouldn't mind having a MP5 to go play with, but i don't intend on using it on a human or any animal. Maybe some of the people around here really should grow up and quit thinking that their way is the only way.

Again a hot topic the media sensationalizes, people kneejerk react. Saying this will cause a California style shootout is a ridiculous statement from someone not informed of the facts 1; Police went to a local firearms dealer for weapons during that shootout. 2; Criminals are not going to obtain these legitimately. 3; State law currently makes it impossible for a legitimate dealer in KS to conduct business. 4; This only comes to the legislature from voters. A vote count of 105/18 shows people have spoken loudly. 5; If passed like the Concealed Carry License a background check will ensue. 6; If patterned after Oklahoma you pay a permit fee for each weapon. Commenting on forum at KAKE TV’s website may be a good way to vent that is all it is venting and a very small part of the equation. The true litmus test happens when you (here is the important part) THE REGISTERED VOTER and wield your sword of freedom and VOTE! Non voters only need look in a mirror for the reason of pass or fails.

This is great news, really. It's too bad about the title of the article though. But hey, that's how news stations get you to watch and or read. Some of the anti comments are kind of funny (Sad too). Does the person who said "I only hope that this does not put guns in the hands of our school children" really believe that?! It is amazing the things some people will believe.

a lot of dummies just read the headlines, the bill is to allow dealers to sell machine guns to law enforcement. not to the general public. there are still many federal laws on the books to limit sales of machine guns to the public.

What does the public need automatic weapons and silencers for? I like being able to own a gun, I pray I never have to use it but if I had to defend myself or my kids I wouldn't hesitate to pull that trigger. Other than shooting for sport, I couldn't see any reason to own a fully automatic weapon. What could an automatic weapon accomplish that my semi-auto couldn't? Just being able to hold down a trigger to mow things down without having to worry about aiming and missing? Sorry but if you can't aim a gun and hit your target what are you doing owning one to begin with? Silencers? Come on, what do the public need those for? Just to have one? So everyone can run around and play Hitman?

I have noticed how none of the Anti's posting here have actually responded to the fact that 40 other states allow these already? I guess when all you have is a feeling to base your position you can't argue facts? For the poster that said "why aren't these nuts in Iraq?" Have you deployed there? I bet not. I have, amongst other places. If you haven't then maybe you should stop telling others they should.

Robert, your a liar. Plain and simple. The shoot out in California was with ILLEGAL weapons. Obviously, criminals do not follow laws. The cops did not get automatic weapons from pawn shops, as pawn shops cannot legally sell those. Do you just make up emotional stuff as you go?? Try spreading your lies somewhere else. And while we're on about facts, if you really want to make us safer and save the children why dont you work to ban alcohol or automobiles. Neither of those are Constitutionally protected items and cause FAR more deaths then firearms. Hey, if you dont like it vote with your feet. Theres many states which do not allow ownership of the scary guns, they would welcome you with open arms.

I think Kansas polititions have lost their minds. As a former police officer in Kansas,I found that we were the underdog on the streets as far as weapons. Have you people not learned anything from the deadly shoot out in California when the police had to borrow automatic weapons from pawn shops. (WAKE UP)

I note that the only ones calling for death to the legislators over this change, are those "peaceful" people here who are opposed to the bill. I find this quite odd. When CCW was enacted and vetoed, I don't remember any calls for the governor's death from those who favored CCW.

Must be something in the water in Wichita. Why do they live in fear and want to control everyone else? Perhaps withita should pass a law making it illegal to commit crimes. For the rest of us this is GREAT news. More freedoms given to the people is never a bad thing. Finally Kansas takes a step forward in joining the other dozens of states which allow this. And to the lady from Colorado.....Your state already allows ownership of all these and more. But I wont let facts rain on your emotional parade of saving the children. :)

I recall that essentially the same fears were raised with concealed carry, how there would be blood in the streets, etc. It didn't happen with concealed carry and the blood won't flow here either. What are you Libs whining about? This has nothing to do about owning auto weapons or silencers. This is about personal responsibility. Unfortunalty bad people do bad things. Firearms are tools. So what if a person want to collect tools. This is like saying we need to outlaw a 6" steak knives when you only need 2" to cut your meat. 6" makes it more dangerous. Who cares. If a person is responsible and knows how to handle a long steak knife, then this is not an issue What we need is stiffer penalties for those that break the law. Instead of putting limits on law abiding individuals. If your going to put limits on dangerous things, then are you going to limit the weight and size of a basball bat, a brick, a long stick, a golf club or how about how large of a hammer a home owner can own. All these things have been used in murders in Wichita in recent years.

Do you actually think that someone, just because they can pass the tremendous background checks (= law abiding) and pay the ENORMOUS price to own one of these firearms, will go out on a rampage? Use your heads. It is the owner of the weapon that does harm, not the weapon itself. My gun has never jumped off the table and shot someone. There are several other states that allow these items; is blood running in the streets by the hands of the law abiding citizen? Last I checked it's still the thug with an illegal weapon out doing harm. People fear what they do not know; put your Hollywood DVD on pause and start doing some research. Get to know some responsible gun owners; go take a class! Learn that not everything is bad! Educate yourselves! There were such fears when Concealed Carry was passed; it's been over a year. Living in America is about choice. If I can legally qualify to own a particular weapon why should I be denied that right? The background checks to own these weapons includes KBI,ATF, and FBI as well as an approval by the purchaser's local chief of police on departmental letterhead. The cost is on average $15,000.00 and it takes several months to qualify. This is the ultimate gun registration for all you anti gunners out there. There are only about 5 states in our country that do NOT allow these weapons currently. There have only been 2 felonies committed with legally transferrable machine guns since 1935. Criminals will not be a factor in this debate. These weapons are of historical value, an appreciating investment (10% per year on average), and are enjoyable to shoot. Current Kansas law won't even allow licensed dealers to sell to law enforcement. This bill would allow Kansas to follow existing Federal law instead of depending on our Attorney General to write opinions.

Military re-enactors are one group that would benefit as well from this chance. Try being a member of a machine gun squad and all you can fire is one blank at a time and have to recharge the weapon every time. Not realistic. Everyone should as well remember that the criminals outgun the police almost all the time, this makes it legal for a dealer to own the weapons and other accessories so the police can get them for your protection. No one HAS to grow up in fear of anything, you the parent TEACH the children fear. A famous man once said We have nothing to fear but fear itself. I believe this is a step forward for Kansas and law abiding Kansans to protect your rights under our constitution.

Machine guns are legal to possess in over 40 states (including all states surrounding Kansas). They are regulated by and registered with the federal Bureau of Alcohol Tobacco and Firearms - have been since the 1930's. Buying one requires a federal background check and local police chief approval. Meliss, hate to break the news to you...but Colorado is a HUGE machine gun state! They have a couple of big shoots there every year, folks from all over the country bringing their machine guns to Cheyenne Wells. The owners are responsible, follow the ATF rules, and are probably more careful with their guns than just about anyone. One final point - machine guns are *expensive* - they range from $3000 for a cheap one to over $30000 for a Thompson (think "John Dillinger"). So folks won't be brandishing them in the back windows of their trucks. They are collectables and many are very historic. This bill only helps collectors and won't increase crime - common-sense legislation.

This is the best news EVER! I am so happy I moved back to Kansas! I am an Avid shooter and now I don't need to worry about noise pollution. Guns are so loud and should be suppressed. It's just common courtesy. You have to jump through a ton of hoops to get one of these pieces of equipment and pay at least $200 just for a tax stamp. The wait could be up to 6 months roughly. There should be no worries. Besides, if someone really wanted to go on a rampage killing spree, they would do it with whatever they had. Your chances of living are probably higher if they use a machine gun due them not being able to control it because they probably haven't had the proper training. Out of the 50 states, I think only 13 don't allow these types of weapons. There shouldn't be any concerns, we are in good hands. Just think, if someone does break into your house, you can tag them with a full auto weapon! This could very well make bad guys think twice... I know it would me.

Nationwide there are over 100,000 "registered machine guns" in private hands. Can anyone tell me the last time one was used to commit a crime? I don't think so. Why? Because the people who go through the process to legally own one are not criminals. They don't commit crimes. Kind of like concealed carry permits. People who go through the process and put themselves under the microscope are not the type of people who are likely to use them to commit crimes. Have any of the apocalyptic predictions of the people who opposed concealed carry come to pass? No, and nothing bad will come from this legislation either. And why would anyone want one? Why would anyone want a car with 450 horsepower?

You were wrong then and you are wrong now. Oh, and Meliss from Colorado: This law is the same as the one Colorado has, every state that borders Kansas and 36 other states. You might want to actually know your laws in Colorado before posting uniformed comments. You are also wrong about crime in Denver. First, Denver is not even double the size of Wichita. Second, Denver is higher than Wichta in every crime category, the average murder rate is about 4 times higher than Wichita which is only abour 200k less in Population. You might want to check the FBI report for crime statistics before pretending you know something. I for one, am ashamed you are from Kansas also.

Kansas is one of the minority of states the do not allow these type of weapons. When was the last time you heard of a machine gun used in a crime. I will tell you now that if it was used in a crime it was an illegally converted or smuggled in gun. I do not know this number to correct at this date but I read that about 10 years ago that only 2 since 1934 of the over 100,000 illegal machineguns had ever been used to commit a crime and those where stolen for a legal owner. It is quite expensive to own a legal machine gun or silencer and they do not create a threat to public at large. Almost all legal machine guns start at $10,000 and run upward of $100.000. These guns are not used in crimes, they are collectables and investments for the owner. I know some of you do not like them that is your right but why should you care if someone else ownW

Most other states allow individual owner ship of machine guns. Buying a machine gun isn't like buying a regular gun. To buy one in another state you have to pay a tax of $200.00 plus pass a more intense background check plus theres a waiting period. Cost of machine guns range from 3k-100k so not everyone will be able to afford them. So there would be a limited amount of ownership. As for increase in crimes with machines you will prolby find less than 0.01 percent of crimes are commited with one and probly less than that. As most people don't know the differents between a machine gun vs a semi auto. There are alot of AK-47 out there but that doesn't make them a machine gun as they only shoot one round a time and you can no longer make machines for individiaul owner ship as USA ban production of machine guns in 1986 so only ones that are made before 1986 can be transfered to individuals. Please get your facts straight

Oklahoma citizens have been able to own these weapons for years and you don't hear about any problems there; you have to be fingerprinted ; have an FBI background check and allow ATF to enter your home at any time without a warrant ; this is not a casual undertaking for owners; the libs are already screaming but OK has had this for YEARS with no problems at all ; all you socialist libs said CCW would result in blood in the streets and you were wrong then as usual

Ownership of automatic weapons and suppressors is currently regulated by the National Firearms Act branch of the BATF. Thorough background checks of every applicant are performed by this Federal agency prior to any approval for ownership of the weapons or suppressors. Almost every state allows for ownership but relies on Federal regulation. There has never been an occurance of a crime committed with a legally owned automatic weapon or suppressor. FYI

I am a VERY, VERY Strong beliver in an individual's right to keep & bear Firearms. However I believe that NO ONE outside lawenforcement and the Military should have Full-auto weapons or silencers. That is a war fare gun not a gun to just have. the only reason some one would need a gun like that is to kill some one. the city that i live in is 4 times the size of wichita but yet its crime rate and homicide rate is the same. Do you know why that is? I think i have a good idea its because they actually work together as a state and city not against each other like its a competition. My car broke down and i was fixing it and my neighor didnt ask me if i wanted help he just started helping me. That would never happen back home. Every one there is to caught up in there own lives that they forget about the other person but yet they expect every one to help them when something bad happens to them. I am now proud to live in Denver, CO.
