Jail Deputy Rearrested On Additional Sex Crime Charges

A Sedgwick County jail employee has been rearrested on additional charges of sexually assaulting inmates.

Jail records show David E. Kendall, 21, a detention deputy, was arrested after 4:30 p.m. Friday. The arrest comes one day after Kendall was released on bond.

Kendall was picked up on a new warrant booked on a total of 12 counts, including 2 counts of aggravated criminal sodomy, 3 counts of sexual battery, 6 counts of unlawful sexual relations, and making false information, said Watch Commander Lieutenant Robert Taylor.

Kendall has been placed on administrative leave.

A Sedgwick County Detention Deputy charged with sex crimes within the jail has been released on bond.

David E. Kendall, 21, was released on a $100,000 bond late Thursday morning and has been ordered to wear an electronic monitoring device.

Kendall was booked Tuesday on seven counts of sex crimes within the jail. He is charged with two counts of aggravated criminal sodomy, two counts of unlawful sexual relations, two counts of mistreatment of a confined person and one count of sexual battery.

He is scheduled to appear in court on July 5th.

The Federal Bureau of Investigations has confirmed the department is conducting its own investigation into a Sedgwick County detention deputy accused of raping two inmates.

Authorities arrested David Kendall, 21, on Tuesday with seven counts of sex crimes. The arrest stems from two separate allegations that Kendall sexually assaulted inmates in their jail cell.

Sheriff Bob Hinshaw said in a news conference Tuesday that the department believes there is probable cause that Kendall committed those crimes. Hinshaw called the allegations embarrassing.

Bridget Patton, FBI spokeswoman, said the agency has opened its own civil rights investigation.

Kendall is expected to make a first appearance in Sedgwick County District Court this week on the seven criminal charges.

Sedgwick County officials arrested one of their own after finding probable cause in connection to recent inmate rape allegations.

Authorities booked David Kendall, 21, on seven counts of sex crimes within the jail. He is being held on two counts of aggravated criminal sodomy, two counts of unlawful sexual relations, two counts of mistreatment of a confined person and one count of sexual battery.

Kendall is accused of sexually abusing an inmate in his cell June 3. Attorney Mark Schoenhofer says a second victim filed a claim Monday.

Sheriff Bob Hinshaw said the department believes there is probable cause that Kendall committed those crimes. Hinshaw called the allegations embarrassing.

The deputy, who has been with the department since 2008, is being housed in the medical clinic. He is being held without bond.

Hinshaw said the FBI is working with the sheriff’s department on the investigation. He said the Department of Justice may open its own investigation.

The case will be turned over to the district attorney's office for review.

The Sedgwick County Sheriff's office said a detention deputy accused of sexual misconduct has been arrested.

On Tuesday, authorities arrested David Kendall, 21, for two counts of aggravated criminal sodomy, two counts of unlawful sexual relations, two counts of mistreatment of a confined person and one count of sexual battery.

The arrest stems from an allegation that Kendall sexually abused an inmate in his cell June 3. Attorney Mark Schoenhofer says a second victim filed a claim Monday.

The case will be presented to the District Attorney's office for review.

The Sedgwick County Sheriff's Office is beginning the early stages of a second investigation after a another rape allegation surfaced against a jail deputy.

The attorney representing the first inmate tells us he's gotten several calls from others inside the jail who claim the same deputy had approached them and offered them things for sex, although he says in all those cases nothing physical took place. He says it wasn't until late last week that he discovered a second victim.

It's the second rape allegation in as many weeks. The attorney representing both inmates says the two men have never met, but he says their tales are eerily similar.

“These were incidents that happened without the other knowing that it was taking place. Our investigation seems to support what each other are saying, they corroborate each others stories,” attorney Mark Schoenhofer said.

Schoenhofer says the second inmate told him he was actually raped three months ago but only came forward after hearing the first inmates story about the same jail guard.

“For three months now he has been silent about it for a couple of reasons. One he was afraid, he was threatened, and secondly he felt very alone,” Schoenhofer said.

We spoke with Sedgwick County Sheriff Robert Hinshaw. He tells us his office only found out about the second allegation through the media.

“Neither of the plaintiff's attorneys contacted us to let us know there was a second allegation. We actually had to call one of the attorneys and he did give us the name of the inmate,” Sheriff Hinshaw said.

Sheriff Hinshaw says his investigators have already started looking into the fresh allegation along with the FBI. He tells us he contacted their office late last week to assist his office on the investigation.

“While I have full confidence based on past record of criminally charging and terminating people regardless of if criminal charges were filed, this is a matter of public concern,” Sheriff Hinshaw said.

A representative with the FBI tells us for now they will continue to assist the sheriff's office with their investigation. It will be up to the Department of Justice whether they launch their own, separate investigation.

Both of the inmates are still in custody. One has been transferred out of the Sedgwick County Jail and Schoenhofer tells us he hopes to have the second man transferred soon.

The deputy in question is on administrative leave.

A Wichita attorney confirms a second jail inmate has come forward claiming he was raped by a Sedgwick County Deputy.

Attorney Kurt Kerns says the inmate's story is eerily similar to that of another inmate who says a jailer raped him inside his cell.

Last week KAKE News reported an inmate being held on drug charges claimed a deputy handcuffed him and sexually assaulted him on June 3.

Kerns says the most recent allegation of rape happened two months ago. This inmate says the same jailer woke him inside his cell, braced him up against the wall and raped him.

Kerns is waiting on DNA evidence before filing any kind of lawsuit.

Sedgwick County Sheriff Robert Hinshaw says his office has contacted the FBI to assist in the investigation. Sheriff Hinshaw said he was not aware of the second allegation.

The deputy has been placed on paid administrative leave.
