Kansans who purchased a Skechers shoe claiming to shape and tone legs, may be getting their money back.

"I wasn't expecting to get any more toned just from these shoes. I thought that maybe, in addition to things I was doing on my own, it would help, but definitely not expecting miracles just from these shoes," said Ashley Abedini, who bought a pair of Skechers Shape-Up.

Derek Schmidt, Kansas Attorney General, announced Wednesday that his office filed a settlement with Skechers USA Inc. to resolve allegations over the company’s Shape-Up athletic shoes.

The lawsuit alleges that Skechers claimed their rocker-bottom shoe products caused consumers to lose weight, burn calories, improve circulation, fight cellulite, and firm, tone or strengthen thigh, buttocks, and back muscles without having adequate support for its claims.

The multi-state settlement requires Skechers to allocate up to $40 million for consumer refunds nationwide. Forty-two other states also joined the settlement.

"Deceptive marketing practices and failure to substantiate advertising claims prevents consumers from making informed purchasing decisions," Schmidt said. "This settlement is a win for Kansas consumers."

Skechers did not admit any wrongdoing and denies the factual allegations asserted in the complaint.

Kansas consumers who purchased Shape-Ups, Tone-Ups, or the Skechers Resistance Runner should go to the Kansas Attorney General's Website for information about how to obtain a partial refund.

Consumers can also contact the Attorney General's Consumer Protection Division at 1-800-432-2310 for more information.
