Noe Barron Jr., 21, was scheduled to be in Sedgwick County Court this morning for a hearing to determine if enough evidence exists to send him to trial on first degree murder charges.
Barron is accused of killing 4-month-old Victoria Barron, the youngest of his three children, last October. She was rushed to a hospital on October 10, and died six days later. Police say she showed signs of child abuse. A charging document filed against Barron says the girl was shaken.
Moments after arriving in court, Barron changed his mind -- opting to waive his right to a preliminary hearing. The waiver allows a judge to find probable cause to believe Barron comitted the crime, and schedule him for trial.
Judge Robb Rumsey entered a plea of "not guilty" on Barron's behalf. His trial is scheduled to begin on May 4.
