UPDATE: McPherson Homicide Investigation Continues

New details are emerging about the death of a 30-year-old McPherson man. Police launched a homicide investigation after they received a tip Sunday that someone had killed 30-year-old Justin Milne. Later that night, authorities found Milne's car on fire near Marion Reservoir. The next day, they found his body at a secluded campsite in the area.

Tuesday, police confirmed they don't believe he was killed where his body was found, but rather at a home in McPherson. That home is in the 500 block of North Cherry, where 24-year-old Dustin Tyler Smith lives. Smith was arrested for first degree murder after investigators found him near Milne's burning car on Sunday.

Police continued to keep watch over the house on Tuesday. It's located in what neighbors describe as a 'quiet' neighborhood.

"Very nice, very nice neighborhood, very quiet. Everybody gets along, everybody's real friendly," said Robert Clark, who lives near the alleged crime scene.

Clark and many of his neighbors say they're shocked a murder may have happened just a few houses down. They say the surprise comes both because a homicide is rare for their town, and because they originally believed the murder happened in Marion County, where Milne's body was found.

"I was really surprised because we watched it on the news last night and we thought it probably happened up at the lake," said Clark.

The McPherson Police Chief confirms the killing may have been over money, which is something those living near the alleged crime scene call 'senseless.'

"Yes it is, it sure is. It's senseless," said Clark.

It's also 'senseless' according to those who knew Milne.

"He was nice and he was someone that I could talk to," said his friend Mindy Herpich. "It's hard when it happens to someone you know, and it hurts."

An autopsy on Milne was performed Tuesday, but police are not yet releasing the results.

The McPherson County Attorney says he expects to file charges in the case within the next day.

A body matching the general description of 30-year-old Justin Milne of McPherson was found near a secluded campsite in Marion County. The victim was later identified by family. Milne had been reported missing since Sunday after police learned his black 1998 Chevy Tahoe was found fully engulfed in flames. Milne was not found at the scene.

Police had identified a possible suspect in the investigation, and arrested him in connection with Milne's disappearance. The KBI was called to assist in the crime scene investigation at Marion, and to assist in a search warrant of the suspect's house in McPherson.

The Kansas Highway Patrol, Kansas Department of Wildlife and Parks, McPherson Police Department, and the Marion County Sheriff's Office, also assisted. Police are asking if anyone has any information that may be helpful in the investigation, to call 620-254-1200 or McPherson County Crimestoppers at 620-241-1122.

McPherson authorities are searching for a 30-year-old male, who may be a victim of foul play.

According to McPherson Police, officers attempted to locate Justin Milne and his black 1998 Chevy Tahoe Sunday night.

Around 6:30, officers found out his vehicle had been located in Marion County, and was fully-engulfed in flames. Milne was not found at the scene.

Police arrested a 24-year-old McPherson male at the scene, in connection with the suspected disappearance of Milne.

The Kansas Bureau of Investigation was called to assist in the crime scene investigation in Marion County. KBI also assisted in a search warrant of the suspects house in McPherson.

Anyone with information on Mile's whereabouts is asked to call McPherson Police at 620-245-1200 or McPherson County Crime stoppers at 620-241-1122.
