A former Wichita police officer accused of several sex crimes appeared in court today for a motions hearing.

Joseph McGill, who has already been convicted of sexual battery on a another case, will wait until next month to hear a judge's ruling. The judge will rule on whether there is or is not enough evidence for a jury trial.

McGill is accused of two counts of aggravated indecent liberties with infant children.

State prosecutors have presented two witnesses who said McGill confessed to the alleged crimes. The first witness, his wife, testified in the preliminary hearing. The second witness, McGill's psychotherapist, testified in court today.

"I was shocked," said Bradley Mills, psychotherapist. "Even though I've been doing treatment for a long time, this is not something you hear every day."

McGill's defense attorney, Mark Schoenhofer, argued that there was not enough evidence for his client to stand a criminal trial.

"Without that independent corroborating evidence, the extra judicial statements or confessions or admissions by a defendant are not admissible," said Schoenhofer.

State prosecutor, Mandee Schauf, said there was enough evidence, given the two alleged confessions and the correct ages of the victims.

"Why are there no victim statements? Because he was smart enough to choose two victims that were nonverbal, who could not convey what happened to them. One was three months. One was a year," said Schauf.

District Court Judge Jeff Syrios will make a public ruling on Sept. 21 at 8:45 a.m. Syrios said a written ruling may come before that date.
