Attorney General Steve Six announced today that 22-year-old Luis Antonio Aguirre was charged in Riley County with capital murder in the death of 18-year-old Tanya Carmen Lydia Maldonado and her 15-month-old son, Juan Maldonado.

Law enforcement alleges that Aguirre killed the mother and son around September 19th, 2009, and buried them in shallow grave near Ogden. Their bodies were discovered by hunters a few weeks ago. Aguirre was arrested in Texas on October 30th and transported back to Kansas last week. His first court appearance was today at 1:30 p.m.

The Death Penalty Defense Unit was appointed to the case. Bond will stay at $2.5 million and the next hearing is scheduled for December 7th at 3:30 p.m. These are only allegations and Aguirre will be presumed innocent until proven otherwise in a court of law.
